Terms & Conditions

These Terms & Conditions set out the terms on which Tweak provides its career, recruitment and marketing services.
By purchasing a service, booking a project, accepting a proposal or engaging Tweak on an ongoing basis, you agree to these Terms & Conditions.
“Tweak”, “I”, “me” and “my” refer to Daniela Mizzen trading as Tweak. “You” and “your” refer to the person or business purchasing or engaging my services.

1. What Tweak does
Tweak provides two main types of support:
Career and recruitment support
This includes services such as:
CV reviews
CV writing and editing
CV design
Cover letter writing
LinkedIn profile optimisation
career support and coaching
personal branding
recruitment support
candidate CV and profile support for recruitment businesses
recruitment marketing
Marketing and business support
This includes services such as:
marketing strategy
positioning and messaging
copywriting and content
brand building and design
social media
email marketing
website strategy, copy and builds
SEO and search marketing
paid advertising
PR and communications
photography and videography
project and marketing support
ongoing marketing retainers
personal and virtual assistance
Not every service is delivered directly by me. Where a project requires specialist expertise, I may bring in trusted freelancers, agencies or other specialists from my professional network.
Where this happens, I remain your main point of contact and will manage the project and overall quality of the work. I'll be transparent about who is involved.
2. Different ways of working with Tweak
The way you purchase and work with Tweak depends on the service.
Career services
Many career services are fixed-price services that can be purchased directly through the website.
The relevant service page will set out the price, what is included and, where applicable, the expected turnaround time and number of revisions.
Marketing packages
Marketing packages are focused projects designed around a particular problem or outcome.
Each package has a defined scope, outcome, timeframe and price.
The package description on the Tweak website, together with any proposal or written confirmation provided to you, forms the basis of the work we agree to carry out.
Current packages may include the Tweak Marketing Foundation, Tweak Marketing MOT, Tweak Your Positioning, Website Tweak and Campaign Sprint.
Bespoke projects
Not every piece of work will fit neatly into a package.
Where we agree a bespoke project, I'll provide a proposal, quotation or written scope setting out what I'll do, the expected deliverables, timescale and price.
Monthly retainers
For businesses that need ongoing marketing support, Tweak offers monthly retainers.
Retainers provide an agreed amount of Tweak time each month rather than a fixed list of deliverables or unlimited access.
The specific retainer, monthly fee and allocation of time will be agreed before the retainer begins.
3. Your booking or purchase
When you purchase a service online, accept a proposal or otherwise confirm that you want to proceed, you are agreeing to these Terms & Conditions.
For business projects, I'll normally confirm the scope, price and proposed start date in writing before work begins.
For online career services, your order and the relevant service description will form the basis of the agreement.
I reserve the right to decline a booking or project where I don't believe Tweak is the right fit or where the requested work falls outside the services I provide.
4. Prices and payment
Prices are shown on the relevant service or package page or will be confirmed in a proposal or quotation.
Unless otherwise agreed:
fixed-price career services are paid for when purchased;
fixed-price marketing packages may require payment in full or an agreed deposit before work begins;
bespoke projects will follow the payment schedule set out in the proposal or invoice;
monthly retainers are paid in advance each month.
All prices will make clear whether VAT is applicable.
For invoiced work, payment is due by the date shown on the invoice.
If payment is overdue, I may pause work until the outstanding amount has been paid. I reserve the right to charge statutory interest and compensation on overdue business-to-business payments where applicable.
5. What's included in a service or package
The work included will depend on the service you've purchased.
For fixed-price services and marketing packages, the relevant service description will set out the scope and deliverables.
I will do my best to deliver what has been agreed, but a package is not intended to be an unlimited service.
If you ask for additional work, substantial changes or work outside the agreed scope, I'll let you know before carrying it out. Additional work may be quoted separately or charged at an agreed rate.
I won't deliberately add unexpected charges without discussing them with you first.
6. Marketing retainers
If you work with Tweak on a monthly retainer, your retainer gives you a set amount of Tweak time each month.
That time can be used across the marketing priorities that make the most sense at the time.
For example, one month might involve strategy and planning, while another might involve copywriting, email marketing, social content, a campaign or website updates.
You're therefore buying a flexible marketing resource rather than a fixed list of monthly deliverables.
Unused retainer time does not automatically roll over into the following month unless we have specifically agreed otherwise in writing.
If you need additional time during a month, I may be able to provide it subject to availability. Any additional work or time will be agreed with you before it is carried out.
I will keep you reasonably informed about how your retainer time is being used.
7. Timelines and delivery
Where a turnaround time is stated on a service or package page, that timeframe is an estimate based on receiving everything I need from you promptly.
For larger projects, I'll agree a proposed timeline with you before work begins.
Timelines may change where:
you are late providing information, content, access or approvals;
you request changes to the original brief;
additional work is added;
third-party suppliers are involved;
circumstances outside my reasonable control affect delivery.
If something is likely to have a material impact on the agreed timeline, I'll let you know.
8. Your responsibilities
To help me deliver the work properly, you agree to:
provide accurate and complete information;
provide any documents, content, images, access or other materials I reasonably need;
make sure you have permission to use anything you provide to me;
respond to questions and requests for approval within a reasonable timeframe;
review work and provide clear feedback;
make decisions and provide approvals when reasonably required.
If you don't provide information, feedback or approval when needed, this may delay the work and may affect the agreed delivery date.
For career services, you are responsible for ensuring that the information you provide about your employment history, qualifications, experience and achievements is accurate.
9. Revisions and changes
Where revisions are included, the number of revision rounds will be stated on the relevant service page, package description or proposal.
A revision means reasonable changes to work based on the original brief.
A significant change of direction, new brief or request for substantially different work may fall outside the agreed scope.
If this happens, I'll discuss the additional work and any associated cost with you before proceeding.
10. Career services
Career services are designed to help you present your experience, skills and personal brand more effectively.
For CV writing, LinkedIn optimisation, cover letters and related services, you are responsible for providing accurate information and reviewing the final work before using it.
I will use the information you provide to create or improve your materials, but I cannot guarantee that they will result in interviews, job offers, promotions or other career outcomes.
Where a Kickstarter call or similar consultation is included with a service, the relevant service page or booking confirmation will explain how this works.
If you miss a scheduled call, I may offer a further opportunity to reschedule. Any specific cancellation or rescheduling arrangements communicated at the time of booking will apply.
11. Recruitment services and recruiter partnerships
Where Tweak provides recruitment-related services, including candidate CV support, recruitment marketing or recruiter partnerships, Tweak acts as an independent service provider.
Unless expressly agreed otherwise in writing:
Tweak does not act as an employment agency or employment business;
Tweak does not make hiring decisions;
Tweak does not guarantee interviews, job offers, placements or successful hires;
Tweak is not responsible for decisions made by recruiters, employers or third-party recruitment platforms;
introductions between candidates, recruiters and employers are made in good faith and do not guarantee employment or an ongoing commercial relationship.
Where you are a recruitment business or employer, you remain responsible for your own recruitment decisions and for complying with applicable employment, equality, privacy and data protection laws.
12. Websites, platforms and third-party services
Where Tweak works with third-party platforms, suppliers or specialists, the relevant terms and conditions of those providers may also apply.
This may include website platforms, hosting providers, email platforms, advertising platforms, social media platforms, stock image providers and specialist freelancers or agencies.
I cannot guarantee the uninterrupted availability, functionality or future operation of third-party platforms.
Where a third-party service changes its pricing, functionality, policies or availability, this may affect your project or ongoing service.
I will do my best to flag material issues where they affect work I'm providing.
13. Intellectual property
Unless otherwise agreed in writing, Tweak retains ownership of its pre-existing materials, methods, processes, templates, frameworks, know-how and other intellectual property used to deliver the service.
Once you have paid in full for the relevant work, you may use the final agreed deliverables for the purpose for which they were created.
For example, this may include using final approved marketing copy on your website, using a completed CV when applying for jobs, or using campaign materials in your business.
Third-party materials remain subject to the relevant third-party licence or usage terms.
Where a website or other project incorporates third-party software, fonts, images, templates, plugins or other licensed materials, you may need to maintain the relevant licence after the project has ended.
Unless we have agreed otherwise in writing, Tweak retains the right to refer to completed work in its portfolio, website or marketing materials.
If a project is confidential or you do not want it used publicly, please tell me before the work begins so we can agree this in writing.
14. Confidentiality
I will treat confidential business, personal and commercial information you provide to me as confidential and will not knowingly disclose it to third parties except where:
you have given permission;
disclosure is necessary to deliver the agreed service;
disclosure is required by law; or
disclosure is made to a professional adviser or trusted collaborator who needs the information to carry out the agreed work and is subject to appropriate confidentiality obligations.
You agree not to share Tweak's confidential business information, proprietary processes, templates or internal documentation with third parties without my written permission.
15. Data protection
I will handle personal information in accordance with applicable data protection legislation and Tweak's Privacy Policy.
Where you provide personal information belonging to someone else — for example, candidate information as part of a recruitment project — you are responsible for ensuring that you have a lawful basis for providing that information to me.
Where Tweak processes personal data on your behalf as part of a business service, we will agree any additional data processing requirements where necessary.
16. Results and outcomes
I will provide professional advice and carry out the agreed work with reasonable care and skill.
However, marketing and career outcomes depend on many factors outside my control.
I cannot guarantee:
job interviews or job offers;
successful recruitment or placements;
search engine rankings;
website traffic;
social media growth;
enquiries or leads;
sales;
business growth;
media coverage;
a particular return on investment;
or any other specific commercial or career outcome.
For marketing projects, results may depend on factors including your market, competitors, budget, pricing, implementation, customer behaviour, economic conditions and third-party platforms.
For career services, outcomes may depend on the job market, your experience, the roles you apply for and decisions made by employers and recruiters.
17. Cancellation and refunds
Cancellation and refund rights depend on the type of service and whether you are purchasing as a consumer or as a business.
Nothing in these Terms & Conditions is intended to remove or restrict any rights you have under applicable consumer law.
Career services purchased by consumers
If you are purchasing a service as a consumer, you may have statutory cancellation rights under UK consumer law.
Where a service is due to begin during the statutory cancellation period, I may need your express request to begin the service early.
If you ask me to begin work during that period and subsequently exercise a cancellation right, you may be required to pay for the proportion of the service already provided, where permitted by law.
Some services may become exempt from cancellation rights once they have been fully performed with your agreement and acknowledgement where applicable.
The specific cancellation rights applying to your purchase will depend on the nature of the service and how it was purchased.
Marketing projects and business services
For business services, cancellation arrangements will depend on the project or package you've purchased and any proposal or written agreement we have entered into.
If you cancel after work has started, you remain responsible for paying for work already completed and any non-refundable costs or commitments reasonably incurred on your behalf.
Where a deposit or upfront payment has been agreed, the relevant proposal will explain how this is treated if the project is cancelled.
Monthly retainers
Unless otherwise agreed in writing, monthly retainers require 30 days' written notice to terminate.
You remain responsible for fees due during the applicable notice period.
If you ask to cancel a retainer part-way through a billing period, the monthly fee will remain payable unless we agree otherwise in writing.
18. Delays, pauses and abandoned projects
If a project is delayed because I am waiting for information, content, access, feedback or approval from you, I may need to move the project delivery date.
If a project is paused for an extended period, I may need to reschedule the remaining work subject to availability.
If you stop responding or do not provide the information needed to complete the work, I may treat the project as cancelled after giving you reasonable notice.
Any fees relating to work already completed remain payable.
19. Limitation of liability
Nothing in these Terms & Conditions limits or excludes liability that cannot legally be limited or excluded.
Subject to that, Tweak will not be responsible for indirect or consequential losses, loss of profits, loss of revenue, loss of business, loss of opportunity or loss of anticipated savings arising from the services, except where such liability cannot legally be excluded.
For business customers, Tweak's total liability arising from a particular project or service will not exceed the total amount paid or payable to Tweak for that project or service, unless otherwise agreed in writing.
Nothing in this section affects your statutory rights if you are purchasing as a consumer.
20. Ending an agreement
Either party may end an ongoing project or agreement in writing where there is a reasonable basis to do so.
I may suspend or terminate services if:
invoices remain unpaid;
you repeatedly fail to provide information or approvals needed to complete the work;
you ask me to carry out unlawful or inappropriate work;
continuing the relationship would create a conflict of interest or other legitimate professional concern.
If an agreement ends, you remain responsible for paying for work completed up to the date of termination and any other amounts properly due under the agreement.
21. Changes to these Terms & Conditions
I may update these Terms & Conditions from time to time.
The version published on the Tweak website will apply to future purchases and engagements from the date it is published.
Changes to these Terms & Conditions will not retrospectively alter the terms of a project, package or retainer that has already been agreed, unless you and Tweak expressly agree otherwise.
Where a specific proposal, package description or written agreement contains terms that conflict with these Terms & Conditions, the specific terms agreed for that project will take precedence to the extent of the conflict.
22. No employment or agency relationship
Unless expressly agreed otherwise in writing, working with Tweak does not create an employment, partnership, joint venture or agency relationship between you and Tweak.
For marketing retainers in particular, Tweak provides an outsourced marketing service and remains an independent business.
23. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
Where you are a business, the courts of England and Wales will have exclusive jurisdiction over disputes arising from these Terms & Conditions, unless otherwise agreed in writing.
If you are a consumer, you may also have rights to bring proceedings in the courts of the part of the UK in which you live, where applicable.
